Understanding Night Work Regulations: A Guide for Temporary Workers 

Working night shifts can be a rewarding experience, offering flexibility and unique opportunities. However, it’s essential to be aware of the regulations that govern night work to ensure your rights and wellbeing are protected.

What Constitutes Night Work? 

According to the UK government, the ‘night period’ is defined as the hours between 11:00 PM and 6:00 AM, unless a different period is agreed upon in writing between the employer and the worker. This alternative period must be at least seven hours long and include the hours from midnight to 5:00 AM

A ‘night worker’ is someone who regularly works at least three hours during the night period

Working Time Limits for Night Workers 

Night workers should not work more than an average of eight hours in a 24-hour period. This average is typically calculated over a 17-week reference period.  

It’s important to note that this limit includes regular working hours and overtime. Employers are required to take all reasonable steps to ensure this limit is not exceeded.  

Health Assessments for Night Workers 

Employers must offer free health assessments to workers before they start night work and on a regular basis thereafter. These assessments are designed to identify any health issues that may be exacerbated by night work. 

While workers are not obliged to accept these assessments, it’s advisable to take advantage of them to ensure that night work does not adversely affect your health.

Rest Breaks and Daily Rest Periods 

Night workers are entitled to rest breaks and daily rest periods similar to other workers. Specifically: 

  • Rest Breaks During Work: If your daily working time is more than six hours, you’re entitled to a rest break of at least 20 minutes. 
  • Daily Rest: You should have a rest period of 11 consecutive hours in each 24-hour period during which you work. 
  • Weekly Rest: You are entitled to an uninterrupted rest period of 24 hours in each seven-day period or 48 hours in each 14-day period. 

These rest periods are crucial for maintaining health and safety standards.

Exceptions to Night Work Limits 

Certain sectors may have exceptions to the standard night work limits due to the nature of the work, such as emergency services or industries requiring continuous operations. In such cases, employers must provide ‘compensatory rest’ to ensure workers receive adequate rest periods.

As a temporary agency worker, you have specific rights under the Agency Workers Regulations 2010. These include: 

  • Equal Treatment: After 12 weeks in the same role, you’re entitled to the same basic working and employment conditions as permanent staff, including pay and working hours. 
  • Access to Facilities: From day one, you should have access to shared facilities and services provided to permanent employees, such as canteens, childcare facilities, and transport services.
